Service Description

This Course critically assesses the remedies available for breach of contract under UAE law. The course places emphasis on when a breach occurs, termination, specific performance (performance by compulsion) and damages for breach. The course highlights the importance of sharia in terms of how it affects the available remedies for breach of contract. Course Aims and objectives are: • Understanding the philosophical and jurisprudential foundation of the law relating to remedies for breach of contract • Understand in detail all the available remedies for breach of contract, such as specific performance, damages, exemption of liability, and liquidated damages agreements. • Appreciate the role of sharia in the determination of which remedies are available, and the limits imposed by the principle of gharar • Brief discussion of the approach under other leading systems such as French and English law. CANCELLATION AND RESCHEDULING BY US At times it may be necessary for us to change the accredited CLPD Course content, and/or Venue from those published. Whilst we will use our reasonable endeavours to provide notice of such changes at least three(3) days’ before the date of the accredited CLPD Course, we will not be held liable for any costs/losses incurred as a result of any such changes. In addition, it may also be necessary on occasion to cancel an accridited CLPD Course, including where the minimum number of participants has not been met. In the event an accredited course is cancelled: we shall endeavour to provide notice of such cancellation to you at least three(3) days before the date of the accredited CLPD Course; your CLPD Account will be refunded ; and cancellation, re-scheduling and non-attendance by you Provided that you cancel your attendance at a accredited CLPD Course at least seven (7) days’ before the date of the relevant Mandatory CLPD Course: your CLPD Account shall be refunded In the event you fail to give prior notice required your Credit in respect of that accrideted CLPD Course will be forfeited and you shall have no entitlement to be to a refund.
